These Terms of Use ("Terms") govern your access to and use of the websites operated by Muse Foundry LLC, doing business as Musical Form Institute ("MFI," "we," "our"), including musicalform.org and registry.musicalform.org (collectively, the "Site").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.
The Site provides information about the certification programs operated by MFI and hosts a public certification registry (the "Registry") that displays information about sound recordings certified under MFI standards.
MFI administers two certification programs:
The Registry is a public verification tool. It enables anyone to confirm whether a specific sound recording has been certified under an MFI standard. Registry entries include the certified recording title, artist, certification identifier, certification date, applicable standards version, and related metadata.
All content on the Site, including text, graphics, logos, images, data compilations, software, and the selection and arrangement thereof, is the property of MFI or its content suppliers and is protected by United States and international intellectual property laws.
The Certificate of Embodied Production name and associated marks are certification marks of Muse Foundry LLC, filed with the United States Patent and Trademark Office under Serial No. 99559776. The Certified Significant Form name and associated marks are certification marks of Muse Foundry LLC, filed with the United States Patent and Trademark Office under Serial No. 99703109.
Use of either certification mark is permitted only in connection with sound recordings certified by MFI under the corresponding standard, and only in accordance with MFI's published Mark Usage Guidelines. Unauthorized use of either mark is prohibited.
The compilation of data in the Registry is the property of MFI. Individual facts contained in the Registry, such as whether a specific recording is certified, may be referenced for informational purposes. The Registry as a compiled database may not be reproduced, scraped, downloaded in bulk, or redistributed without MFI's prior written consent.
You may use the Site for lawful, informational, and verification purposes, including:
MFI accepts submissions of sound recordings for certification review through forms made available on the Site. By submitting a recording for review, you represent and warrant that:
You grant MFI a limited, non-exclusive license to use the metadata and source materials you submit for the purpose of conducting certification review, publishing certification decisions to the Registry, and maintaining MFI's internal records. MFI does not claim ownership of the underlying sound recording.
Where certification depends on a written attestation from an artist, producer, or other party, MFI relies on that attestation in good faith. Material misrepresentation in any submission or attestation is grounds for denial, revocation, or removal from the Registry.
Certain Registry entries may be created or supplemented through automated review of publicly available catalog and recording data. MFI uses third-party services and public APIs to identify recordings, retrieve metadata, and conduct technical analysis as part of its review process.
Inclusion in the Registry as a result of automated review reflects MFI's certification decision under the applicable standard. Subjects of Registry entries may request review or correction in accordance with Section 9.

MFI makes reasonable efforts to ensure that information in the Registry is accurate and current. However:
If you believe a Registry entry contains inaccurate information, was created without proper authorization, or should be reviewed for any other reason, you may submit a request to info@musicalform.org. Please include the certification identifier, the recording title and artist, and a description of the issue.
MFI will acknowledge receipt of correction and dispute requests and will review them in accordance with its published governance procedures. Where appropriate, MFI may correct, suspend, or remove a Registry entry pending review.
MFI maintains documented standards, review procedures, and conflict-of-interest safeguards designed to preserve the independence and integrity of certification decisions. Where any party involved in MFI operations has a production or commercial interest in a recording submitted for review, that recording is reviewed by an independent reviewer in accordance with MFI's governance framework.
MFI publishes its certification standards and governance framework separately on the Site. In the event of any inconsistency between these Terms and a published standard or governance document with respect to certification procedures, the published standard or governance document controls as to those procedures.
The Site may contain links to third-party websites or services, including streaming platforms, label websites, or industry organizations. These links are provided for convenience only. MFI does not endorse, control, or assume responsibility for the content or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their respective terms.
MFI does not require user accounts to access the Registry. If you contact MFI through the Site, or submit a recording for certification review, any personal information you provide (such as name and email address) will be used only for the purposes of responding to your inquiry, conducting review, and maintaining MFI's internal records. MFI does not sell personal information or share it with third parties for marketing purposes.
The Site may use standard analytics tools to collect aggregate, non-personally identifiable information about Site usage for the purpose of improving the Site.
MFI publishes a separate Privacy Policy that describes in greater detail how personal information is collected, used, disclosed, and retained. The Privacy Policy is incorporated into these Terms by reference.
The Site and all content, information, and services provided through the Site are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
MFI does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, MFI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your access to or use of the Site, including but not limited to:
In no event shall MFI's total liability to you for all claims arising from your use of the Site exceed one hundred dollars ($100.00).
You agree to indemnify, defend, and hold harmless MFI, its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
MFI reserves the right, in its sole discretion, to suspend or terminate your access to the Site, without notice, for conduct that MFI believes violates these Terms or is harmful to MFI, other users, or third parties.
MFI may also take any action it deems necessary to enforce these Terms, including seeking injunctive relief or other equitable remedies in connection with unauthorized use of any certification mark or Registry data.
All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, limitation of liability, indemnification, and governing law.
MFI reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the modified Terms. If MFI makes material changes, it will make reasonable efforts to provide notice (such as a banner on the Site or an updated effective date).
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.
Entire Agreement. These Terms, together with the Privacy Policy and any Mark Usage Guidelines published by MFI, constitute the entire agreement between you and MFI with respect to your use of the Site.
No Waiver. MFI's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
Assignment. You may not assign or transfer these Terms or any rights hereunder without MFI's prior written consent. MFI may assign these Terms without restriction.
